CJI DY Chandrachud: We are not in the situation where the state police carries out the investigation. So we'll need a mechanism - in which case what do we do?
CJI DY Chandrachud: We are thinking aloud- we may think of constituting a committee consisting former judges of HC... we'll decide on remit to supervise work of govt. Apart from that, to ensure that process is fair - we would like SG to take instructions on who will investigate
CJI DY Chandrachud: There are eminent counsels on both side. And that's fine because all perspectives should come. But we will be driven by data and that is how we will maintain objectivity.
CJI DY Chandrachud: We will put it to you eventually what solution we want but let there be data. I repeat, our approach is irrespective of whoever has committed the offence. Offence is an offence regardless of who is victim/perpetrator.
Gonsalves: Surely they can focus on the head of the organisation. I gave last time your lordships the beheading of a young boy.
SG Mehta: Let's not instigate...
SG Mehta: There are inspirations coming from somewhere else. That we must resist.
Gonsalves: On 7th I gave so much information with photographs - their Facebooks etc. Today they're saying we don't know.
SG Mehta: Let that be examined.
Gonsalves: Victims are identifying groups which have attacked them.
CJI DY Chandrachud: That is exactly what we want and have asked them to put in tabulated form.
SG Mehta: I didn't object to anyone else but I would object to Mr Gonsalves submitting.
Gonsalves: There is a more direct approach which will have direct effect
