[LIVE UPDATES]SC Hearing Plea By Facebook India Chief Against Delhi Assembly's Summons In Connection With Delhi Riots
Singhvi - I have instructions from the Chairman. This may be recorded. This person is called as a witness. There will not be any coercive action.
Singhvi - Art 19 cannot apply to Petitioner 1(Ajit Mohan) as he is not an Indian Citizen.
Singhvi- Petitioner No.1 has not raised no ground under 14.
J Kaul disagrees - See the grounds. They have raised. Perhaps you are not instructed properly.
Justice Kaul cuts short Singhvi.
Singhvi- My lords heard them for 45 minutes. Give me 15 minutes.
J Kaul (similing)- This is not a TV debate where you are saying they spoke for 5 minutes, give me 5 minutes
Singhvi for Delhi panel - There is a misrepresentation. I submit there won't be any coercive action.
Under 69A & 79 of the IT Act, this Court has said that if there is an incriminating material, anyone can ask the Facebook to take something down. I appear every other day in Delhi High Court where cases are filed against us for taking something down - say hate speech. - Rohatgi
Facebook is answerable only under the IT Act : Rohatgi.
The Chairman says Facebook is guilty, Rohatgi refers to the press conference by the panel. He says the committee has already said FB has colluded with Delhi riots.
"Who are they to say that?", Rohatgi.
The root of the matter is this legislative committee has no power of adjudication. Legislature is no court of justice- Rohatgi
Suppose if I as a lawyer is called by the Parliament to give my views on some subject, can the Parliament say I will be penalized if I don't appear : Rohatgi.
