A Three Judge Bench of the Supreme Court will hear at 10.30am today more than 130 petitions challenging the Citizenship (Amendment) Bill 2019
The Bench comprising of Chief Justice SA Bobde and Justices Abdul Nazeer and Sanjiv Khanna will also hear the transfer petition filed by Centre to tarnsfer the petions challenging the Act pending before various High Courts to Supreme Court.
On December 18 the Supreme Court issued notice on various petitions challenging the Citizenship (Amendment) Bill 2019 and asked Centre to file the response by the second week of January.
AG says after everyone starts moving- I forgot to say, please order that HCs cannot hear the matter while pending in SC.
CJI - "Issue notice on all matters. AG seeks time to reply. 4 weeks for reply. After 4 weeks we will list it for orders. Give us a list of all the categories of matters. Small matters we can hear in the chamber".
Sibal says that the Centre already had 4 weeks and havent filed counter affidavits.
CJI says, "We will grant them 4 weeks time".
CJI says that Assam and Tripura matters will be clubbed together to be dealt with separately.
Court asks Sibal to assist in identifying these matters.
AG prays for 6 weeks time, saying that counter needs to be filed in 80 more petitions.
Singhvi - Without any rules being framed, 40 Lakh people have been marked doubtful. This has happened in 19 districts of UP. Their right to vote will be lost. Kindly stay the process. That's our prayer. This will prevent a lot of chaos and insecurity.
Singhvi says that CAA process has begun in UP
"Two weeks ago people have been marked with tick and cross in UP. Doubtful, maybe, to be verified.
This process has not happened in 70 years, why not wait two more months.
This is happening even without the Rules being made".
CJI agrees to list Assam petitions separately after two months
AG urges Court to list Assam petitions separately after two weeks.
AG says that the Assam NRC will not be operational till the final draft is published by the Registrar General of India.
KV Vishwanathan says that there is a difference between staying the Act and deferring the implementation of the same.
