Chancellor's lawyer to petitioners' lawyers : Don't laugh.
Justice Devan : And if the Supreme Court judgment say it is void abinitio, how can you given them time? And, what was the hurry in issuing the letter?That is also troubling.
Chancellor's lawyer : It may be seen as an appeal.. a request.
Chancellor's lawyer refers to the Supreme Court judgments in Sardar Patel University and Calcutta University cases. He says in those cases, the Supreme Court adversely commented on the inaction of the Chancellor.
Now bench hears the senior counsel appearing for the Chancellor.
Justice Devan : Is it true that you have not sent show-cause notices to persons? How do you send them notices after holding that they have ceased to be in office?
Justice Devan : I am not on the qualifications of the persons at all. Let us understand the contours of my jurisdiction.
Justice Devan : When the Regulations say you should have a panel, you have to have it. The question is if the appointment is as per UGC regulations.
Counsel says Selection Committee has vouched that the person is eminent.
J Devan : The appointing authority need not feel so.
Counsel makes arguments against Supreme Court judgment.
Justice Devan : Please go and argue that before the Supreme Court. Not here.
Justice Devan : Who does the Chancellor report to?
Counsel : Syndicate.
Justice Devan : No, you can't ask the Chancellor to report to the Syndicate. Syndicate, of all the people! My god. You haven't read the statute.
Counsel says the Chief Secretary who was party to the Search Committee was a nominee of the Governor.
Justice Devan : If you get a notice, you will have an opportunity to explain.
