Counsel : Unlike other Universities, the statute for Malayalam University does not authorise Chancellor to remove VC.

Justice Devan : Even if you do anything wrong?

Counsel : Statute does not allow.

Counsel for Malayalam Univ VC : I don't know the reasons as no notice was issued. The Chief Secretary in the search committee is a Malayalam academician.

Justice Devan : We do not know. I may have studied Physics but that does not mean I am an academician in Physics.

Sasidharan : My appointment is a tenure appointment.

Justice Devan : I agree, you cannot be asked to resign. It cannot be put it in writing. I get that point.

Justice Devan : Let us not start with the assumption that the Chancellor is acting with animosity. That is why I said let us be temperate in using words.

Sasidharan : How can he do that?

Justice Devan : Let us be temperate. How can VC use words like "how can he do that". Let us be temperate. At least in my court, I don't allow.

Sasidharan : I will tone down.

Justice Devan : Have you received the new notice?

Sasidharan : What is he saying, that you have ceased to be VC? And what is the point.

Justice Devan : What is the reason stated against you?

Sasidharan : That Chief Secretary was one of the members of Search Committee. Chief Secy was a VC of University. He is an academic person.

J Devan : That we do not know.

PC Sasidharan for another VC : Chancellor is an administrative authority. An administrative authority cannot review the decision unless the review power is conferred. Otherwise there will be anarchy.

Peter : I cannot be asked to resign.

Justice Devan : I understand. You can be removed not asked to resign.

Justice Devan : Suppose there is a scenario if nepotism and the Chancellor is also part of it..what can be done..

Peter : Court can step in.

Justice Devan : How can Court step in unless somebody brings it?

Peter : Suo motu.

J Devan : How can there be suo motu for quo warranto.
