Hijab Ban- Karnataka High Court Full Bench Hearing (Day 8)- LIVE UPDATES
Venkataramani : None of the judgments cited by the petitioners have a dimension of public order.
Venkataramani : To borrow a particular example of other country and impose it on India would be problematic
Venkataramani : Governance is a very heavy subject. Only when there is a breach the courts will interfere. Court will not preach how to govern.
Venkataramani : It is for state to follow due process of law and they do not breach. If state for ensuring order and disciple takes some measures, I feel courts should not hold strict scrutiny.
Venkataramani : As a teacher I would want to have a free mind to teach. Any measure on the part of the State or the school to bring in discipline...Schools stand on a higher footing, where everyone comes together for learning.
Venkataramani : Three propsitions I want to urge before the court. Discipline and order is important for both teachers and students. I am not trying to say Religion A is higher or Religion B is lower. There is no hierarchy of religions.
AG concludes.
Senior Adv R Venkataramani now makes submissions on behalf of teachers who are made respondents in a writ petition.
AG : In parting I want to say, dignity of women must be kept in mind. While coming to court I heard, a beautiful song of Sahir Ludhyanwi..."Naa munh chhupake jiyo..Aur naa sar jhuka ke jiyo..Gamon kaa daur bhi aaye..Toh muskura ke jiyo"
AG: For large number of petitioners who represent women organisations, I am making a statement, dignity of the women must be kept in mind.
AG clarifies that as far as private unaided minority institutions are concerned, the Govt is not interfering with the uniform code and has left it to the institutions to decide.
