Salve now referring to the Delhi Committee headed by Raghav Chadha by which numerous complaints were filed on instances of hate speech on Facebook.

Salve: The reference to cooperative federalism is misconceived. They said if we have cooperative federalism, we can do anything. It cannot be converted to an independent head of power.

Salve: If this has to be done, it should be done by way of a legislation which will be tested before your lordships court. The privileges must be understood.

Salve: The way our constitutional law is developed, any restriction under Art. 19 has to be done by authority of law. The question as to whether the privilege of state legislature can reconcile with the right to privacy and right to remain silence, the answer will be no.

"Our constitutional courts are a court of record but the power to punish is a statutory power conferred by the law. That is the privilege of the court, to function in a manner free from interference." Salve submits.

Salve: The word privilege means it is a shield. It is your privilege. The genesis of privilege is that the privilege of people is against the crown. They have misunderstood the notion of what is a privilege. And it can only relate to legislature and executive.

Salve: If the answer is in affirmative, then how the privilege of the house be reconciled with the Right to Privacy and right to free speech and expression includes the right to silence enshrined under Part III of the Constitution?

“You have no such privilege which will enable you to summon third parties.” Salve submits.
