The Lok Sabha is at present considering three criminal law bills.

The bills are Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagarik Suraksha (Second) Sanhita and Bharatiya Sakshya Bill, which seek to repeal and replace the Indian Penal Code 1860, Code of Criminal Procedure 1973 and the Indian Evidence Act 1872.

The bills were initially introduced by Home Minister Amit Shah in the Monsoon Session and were referred to a Parliamentary Standing Committee. The initial bills were withdrawn and were re-introduced during this session, incorporating certain suggestions made by the Committee. Home Minister Amit Shah said that most of the changes from the first versions are grammatical in nature.

It may be noted that several key opposition members were suspended from the Lok Sabha today. 49 INDIA bloc MPs were suspended from the Lok Sabha today. 33 Lok Sabha MPs & 45 Rajya Sabha MPs from the Opposition were suspended from the Parliament on December 18, 2023. 13 Lok Sabha MPs & 1 Rajya Sabha MP were suspended earlier on December 14, 2023 for the remainder of the Winter Session for “gross misconduct”.

BJP MP PP Chaudhary: Today, the most vulnerable are witnesses. Anyone will think ten times before testifying in court. The Supreme Court and high courts have had to fill in the blanks often because of lacuna in the old laws. 

The three new bills will address several modern problems, including that of delay and arrears, of deficient investigation, of cybercrimes and terrorism, mob lynching, etc.

Tejasvi Surya mentions the recent acquittal of a politician in a hate speech case (Speaker asks him not to mention the name)  : He was acquitted on the premise that the person who recorded the speech did not provide the original DVR in which the speech was recorded. But the speech was telecast live and whole world watched. But the Court ruled that the digital evidence was not admissible since the person who recorded the original DVD did not supply it. So, all other copies available online were not accepted as primary evidence. This was a major lacuna in our Evidence Act, which is cured in Sakshya Bill. As per clause 57, "Where a video recording is simultaneously stored in electronic form and transmitted or broadcast or transferred to another, each of the stored recordings is primary evidence".
