Dyandeo Wankhede Approaches Bombay High Court Alleging Defamatory Statements By Nawab Malik Despite Undertaking To Court

Sameer's father -Dyandeo's- application seeks to place additional instances of defamation on record and appropriate action. The statements were allegedly made to TV9 Marathi and Sakal on 2nd December, 2021 and 4th December, 2021 respectively.

The plea will be considered by the division bench of Justices SJ Kathawalla and Milind Jadhav tomorrow.

In an order passed by consent on November 29, Malik had undertaken not to post any alleged defamatory statements against the Wankhedes till a single judge decides the latter's interim application in the defamation suit.

The division bench of the Bombay High Court then set aside the single judge's order from November 22 refusing ad-interim relief to Wankhede on an appeal filed by him.

Dyandeo had filed a suit and sought Rs. 1.25 crore in damages for defaming him and his family, and ad-interim and interim- directions to restrain Malik or anyone acting on his behalf from posting anything "defamatory" against them.

The consent order was passed in Dyandeo's appeal against Justice Madhav Jamdar's order refusing ad-interim relief to him. Justice Jamadar refused to restrain Malik from making statements against the Wankhedes.

The single judge had also observed Malik had not verified the posts and that his statements appeared to be driven by malice.
