#Breaking: Aryan Khan and 7 other accused remanded to judicial custody in Cruise Ship Drug Case.
Order
Remanded to JC. Accused to be forwarded to special court.
Aryan Khan files for bail. Also an interim bail application.
Order
Considering this fact... I am of the view that no custodial interrogation is required as sufficient time was granted to the IO for investigation.
Order
So far as other accused are concerned, the investigation is silent. No doubt it is their right to claim custody for investigation. But simply remanding the accused to NCB custody would violate their fundamental rights enshrined in the constitution.
Order
Adv for accused rightly argued that when A1 and Aachit were in NCBs custody since October 6, nothing was investigated.
Order
Court says it does not want to go into that aspect, why the IO took so much time to arrest Aachit.
Order
Considering the date of arrest of the accused and taking ASGs arguments as it is, by no stretch of imagination it can be said that the custody of the accused is necessary with the NCB authorities because the statement of A1 was recorded on 3rd wherein he disclosed Aachits name.
