Sachin Waze, dismissed assistant police inspector and prime accused in the Ambani terror scare case, has approached the Bombay High Court seeking house custody for his post bypass recovery after the special court refused him relief.

A bench of Justices Nitin Jamdar and Sarang Kotwal granted the National Investigation Agency one week's time to file a reply to Waze's plea under Article 226 of the Constitution.

Advocate Sudeep Pasbola and Rounak Naik for Waze informed the court that he was shifted from Wockhardt Hospital to Taloja Prison after the special court rejected his plea.

NIA's counsel Sandesh Patil then sought a week to reply.

Waze was arrested on March 13. He is accused of placing the jeep loaded with gelatin sticks near industrialist Mukesh Ambani's residence and planning the murder of businessman Mansukh Hiran.

The NIA charge-sheeted him and six others for murder and under the Unlawful Activities Prevention Act. There are 10 accused in the case.

Waze's Bypass

On September 29, the Special NIA Court rejected Waze's application for house arrest and directed him to be kept in the medical facility room of Taloja Prison to recuperate for a month. Waze's was not a deserving case where house custody can be granted, the court said.

The court had noted that Waze was allowed hospital admission on August 30, followed by a private hospital admission, on September 9. Four days later, he finally underwent an eight-hour-long bypass surgery.

The judge observed that according to a report from Worckhadt Hospital, Waze was found healthy, without any (puss) discharge. While it is true that Taloja prison did not have adequate medical facilities, but he could be treated at the nearby hospital incase of an emergency, the judge said.

"The offence is of serious nature… possibility of his absconding cannot be ruled out. There may be possibility of visiting his relatives at his house and use of electronic devices during his house custody," the court observed.
