A Metropolitan Magistrate Court in Mumbai has issued a proclamation against "absconding" accused Param Bir Singh, former Mumbai police commissioner and two others – Vinay Singh and Riyaz Bhatti - in an alleged extortion case.

Three non-bailable warrants have been issued against him so far.

The case refers to an extortion call made to builder-cum-hotelier Bimal Agarwal between January 2020 and March 2021. The accused also include dismissed cop Sachin Waze, Sumit Singh alias Chintu and Alpesh Patel.

They have been booked under Sections 384, 385 (both pertaining to extortion), and Section 34 (common intention) of the IPC.

The Mumbai police crime branch informed the Magistrate that non-bailable warrants were issued on October 30, but the trio were not available at their respective addresses. Special Public Prosecutor Shekhar Jagtap added that the three seem to have gone into hiding the moment the case was registered against them.

Under Section 83 of the CrPC if the accused the fails to appear within 30 days, then proceedings can commence for attachment of their properties.

On Monday, the Magistrate sought an affidavit form the investigating officer before deciding on issuance of proclamation under Section 82 CrPC.

The agency said its officers had visited Param Bir Singh's Malabar Hill home on November 10.

The police guard told them that for the last three months, Singh had not come to the building. He said Singh's family also did not live there, and he did not know the whereabouts of any of them.
