The Telangana High Court has ordered implementation of a circular issued by the State Government to all function halls across the city of Hyderabad for strict adherence of the Noise Pollution (Regulation & Control) Rules, 2000 and Environment Protection Act, 1986.

The order was passed by the Division Bench of Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti in a PIL that was taken up based on a letter addressed to the Court by a Colonel in the military. In the letter, two function halls within the cantonment were criticized for playing music on loud speakers late into the night statedly causing grave inconvenience to the residents, aside from the traffic problems.

The Court had therefore directed that action be taken in terms of the Noise Pollution Act and Rules.

In furtherance of the same, Additional Advocate General Imran Khan (Sr) informed the Bench that a circular was issued on 12th March and notified to all 70 function halls running within the city.

Further, it was informed that the owners of the function halls and convention centres have also been directed to ensure that functioning of their centres should not result in disturbing the public peace and tranquility, failing which necessary action shall be taken against them under the provisions of the IPC, Section 133 CrPC and under Section 2 of the Air (Prevention and Control of Pollution) Act, 1981.

Lastly, it was stated that measures are being taken to enforce the circular through the State of Telangana.

Similarly, the counsel on behalf of the Cantonment Board K.R. Koteswar Rao reported that a resolution was passed and a notice was issued upon all 12 function halls within the Cantonment area for adherence of noise pollution laws.

Court has now ordered that an action taken report be filed within a month.
