A bench led by CJI DY Chandrachud will hear the matter. Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha are the other members of the bench.
The bench started hearing the matter on merits from February 21. On February 16, it had decided to defer a decision on the preliminary issue of larger bench reference by choosing to determine it along with the merits of the case.

Kaul: What was the hurry? That during the weekend you want the replies to be filed! That's why we moved to this court by 32.
Kaul: They didn't even follow the basic norms of natural justice.
Kaul: The scope for disqualification being misused is enormous and that is what is sought to be done here.
Kaul: Whether Nabam applies or not applies, the court said only on principle of natural justice give them more time because the rules provide 7 days and they only got the weekend.
CJI DY Chandrachud: If Nabam Rebia didn't exist, the Speaker would be entitled to decide disqualification. If he had decided, 39 would have gone out. Then the government would have fallen.
Kaul: Exactly.
Kaul: It's wrong to say that Shinde wouldn't have gotten support. Till he is disqualified, he continues to be a member.
Justice Shah: CJI is saying what if he was disqualified:
Kaul: Speaker couldn't have gone ahead with the disqualification because of Nabam Rebia.
Kaul: Your own people were not there to support your government! That's why this number comes to 99. 13 from MVA abstained. Because you had lost the support.
Kaul: In the chart I gave - Quite apart from removing the 39, they were running from actuals. 13 of them were their own people. That's how they came to 99.
Kaul: These are all hypotheticals.
CJI DY Chandrachud: Not all is hypothetical. We all know what happened and what led to this.
