A plea has been preferred seeking directions for the CBI to take up the investigation in the death of Bollywood Actor Sushant Singh Rajput and the events that led to his untimely demise.
Moved on behalf of Advocate Ajay Agrawal (Petitioner-in-person), the plea highlights that the "upcoming film star was found dead under mysterious circumstances" but the Mumbai police immediately declared it a case of suicide. He adds,
"But nobody could swallow this theory of suicide of a bright carrier upcoming star who played a lead role in the film of 'M.S. Dhoni (released in September, 2016) and became famous all over India. He became a youth icon since in India almost everybody is a Cricket lover and he performed the lead role in the feature film produced by Bollywood on the life of our Great Captain M.S. Dhoni. Listening the news of his untimely and unsavory death every Indian was shocked and curious to know the actual facts of his untimely death"
Stating that, even though, the Top Court had recently dismissed a plea on July 30, seeking CBI inquiry into the actor's death "without any speaking order", the petitioner avers that "much water has flown after filing of the abovesaid petition on 15.7.2020" and "all the Electronic, Print and web news Channels have only one story i,e mysterious death of Bollywood star Late Shri Sushant Singh".
Further to this, the plea states that after an FIR had been filed in Patna by Sushant's father, the S.P. of Patna City was sent to Mumbai for further investigation but he was "put under quarantine by the Bombay Municipal Corporation as soon as he landed in Mumbai on 02.08.2020". This, the SP has alleged was done selectively against him.
"This blatant act of the BMC under the instruction from the State Government of Maharashtra make it loud, clear and apparent that there is something fishy in the investigation of Mumbai Police and it want to hide and suppress some material facts which are necessary for impartial and fair investigation of the case and that is why the present Govt. of Maharashtra is shy of recommending CBI inquiry into the matter wherein its act in this matter is under cloud" - Excerpt from Plea
Agrawal also states that in wee hours of Tuesday (August 4), the Bihar Government has recommended CBI inquiry into Rajput's death but the "Maharashtra Government may not agree for it" and that a CBI inquiry in Mumbai case as well as the FIR lodged in Patna is necessary for arriving at the actual truth to come out in the issue.
Last week, the Supreme Court dismissed a PIL seeking transfer of Actor Sushant Singh Rajput's death case from Bombay Police to CBI.
A bench of Chief Justice SA Bobde, Justices AS Bopanna & V. Ramasubramanian had stated that the petitioner Alka Priya had no locus standi in the matter and that the Mumbai Police is already probing the case and must be allowed to do its job. Court suggested the petitioner file a PIL in the Bombay High Court in order to seek appropriate relief if she had anything concrete to show.
When the petitioner submitted that the Actor was a "good person" and worked towards public interest, the CJI led bench said that the aspect was unrelated to the prayer at hand.
Petitioner: But he had done a lot in public interest. Sent children to NASA
CJI: "This has nothing to do with whether a person was good or bad"
It is pertinent to mention that after Rajput's untimely death on June 14, the call for a CBI probe into the Actor's death has been making national headlines.
A PIL has also been filed by Supreme Court Lawyer Sarthak Nayak before Bombay High Court to hand over the case to an independent probe agency instead of the case being investigated by Mumbai Police which was scheduled to be heard today but cancelled on account of heavy rainfall.
