A bench headed by Chief Justice Chandrachud will hear the petitions.
On Monday, Senior Advocate Raju Ramachandran had mentioned the matter for urgent listing. Agreeing to list the matter tomorrow, CJI DY Chandrachud disclosed that the Supreme Court collegium has taken cognizance of the complaints about Gowri, which came to its notice after the recommendation was made.
Justice Sanjiv Khanna : We are not entertaining the writ petitions. Reasons will follow.

BCI Chariman Manan Kumar Mishra : We checked with bar councils. There has been absolutely no complaints of misconduct against the person.

Grover : If consultative process is not fully informed, then it goes to the root of eligibility. It is judicially reviewable.
Ramachandran : The presumption that collegium has knowledge is dislodged by the CJI's public statement in open court yesterday.
Grover : What the person says in Youtube or writes in media may not have been available to the collegium. Judges opine about antecedents in professional capacity.
Justice Khanna : All that you are saying this particular information "may not" have been available.
Justice Gavai : And the process originates from High Court. Can we presume they are not aware of the antecedents?
Grover : Collegium will go as per the inputs of the Govt. If vital information is not available, for whatever reasons, I am not attributing mala fides, your lordships can direct..
Justice Gavai : That will be setting a wrong precedent.
Justice Khanna : That is going too far.
Justice Gavai : How can we act on conjectures and surmises? There are two consultee judges from Tamil Nadu.
Grover : Issue is whether these factors were known.
Anand Grover : And the collegium process, was not without full knowledge. There was no proper consultative process. It is possible reports of IB did not indicate her articles. To that extent, there can be an enquiry.
Anand Grover : We are not on the political views. The problem is with her views expressed, which are so extreme, that they make it ex-facie evident that she is unfit to take oath as a judge.
