The Supreme Court of India on Tuesday refused to entertain a writ petition filed by conman Sukesh Chandrashekhar and Leena Paulose seeking their transfer from Mandoli jail to any other jail where the present Director General (Prisons) of Delhi in not in charge.

On August 26, by virtue of the Supreme Court's order on August 23, the duo was shifted from Tihar Jail to Mandoli jail in Delhi. The Court's order came after Sukesh had filed a writ petition under Article 32 of the Constitution of India alleging that officials in Tihar are torturing him for not meeting their demands of money. The Enforcement Directorate had opposed the allegations and said that Sukesh was operating his extortion racket from the jail with the connivance of certain officials, against whom action had been taken.
Today, before a Bench of Justices Ajay Rastogi and CT Ravikumar, the advocate appearing on behalf of Sukesh argued that he was being assaulted in the new jail as well.
"He is being assaulted in jail. He is being asked to pay Rs 25 lakhs. He is being pressurised to withdraw the statement made under section 50 of the Prevention of Money Laundering Act and also the writ petition filed before the Delhi High Court seeking an enquiry by the CBI", he argued.
"When was he transferred?", the Bench queried.
August 26, the advocate answered, while explaining that the DG (Prisons) is in charge of the whole Tihar jail and Mandoli is only one of the units of the jail. Mandoli is jail number 14 within Tihar jail.
But these submissions did not convince the Court.
"After the matter being considered by this Court on August 23, the petitioner was shifted on August 26. In a short span, he has come again, with the present writ petition seeking transfer from Mandoli jail to any other jail which is not within the control of the present DG (Prisons). For this grievance, we find no reason to entertain the present petition seeking transfer of jail", the order read.
