A Supreme Court bench led by Justice DY Chandrachud will hear the matters related to the Board of Cricket Control for India's ("BCCI"). The BCCI has now moved applications seeking permission to amend its constitution.

When the matter came before a bench led by the Chief Justice of India on Wednesday, CJI NV Ramana pointed out that the earlier order in the BCCI case was passed in August 2018 by a bench comprising the then CJI Dipak Misra, Justice AM Khanwilkar and Justice Chandrachud.  Of the members of the previous bench, only Justice Chandrachud is remaining in the Supreme Court, as the other two judges have retired. Therefore, the CJI told the Solicitor General of India that the matter will be referred to bench led by Justice Chandrachud.

Based on the recommendations by retired Justice RM Lodha's committee, BCCI had drawn up its Constitution which mandated a three year cooling off after six years in the position for an office bearer- at the state level or the BCCI. In the amendment, BCCI had sought for including the abolition of the cooling period of office bearers like the Secretary and the President which would enable the current President Saurav Ganguly and Secretary Jay Shah to continue in office despite them completing six years in their respective state associations.

On July 21, the Supreme Court had appointed Senior Advocate Maninder Singh as an amicus curiae in the case as the previous amicus Justice PS Narasimha is now a judge of the Supreme Court.

CASE TITLE: BOARD OF CONTROL FOR CRICKET AND ORS. v. CRICKET ASSOCIATION OF BIHAR AND ORS.
