The Supreme Court on Friday considered a special leave petition filed by some of the victims of the 2008 Jaipur serial bomb blasts challenging the judgment of the Rajasthan High Court which acquitted four persons who were convicted to death by the trial court in the case.

A bench comprising Justices AS Oka and Rajesh Bindal allowed the application filed by the victims seeking permission to file the petition and posted the same next week to be considered along with the special leave petition which is filed by the State.

During the hearing when Senior Advocate Mukul Rohatgi, appearing for the victims’ said that the accused persons are still in jail , a Bench of Justices Abhay Sreeniwas Oka and Rajesh Bindal said that it isn't the correct as per the law.

"How can the accused be kept in jail after they have been acquitted?", the Bench asked.

There are other cases against them (the accused), came the reply.

Rohatgi then sought for a stay of the high court's order, terming it as grossly erroneous and contrary to settled principles of law of appreciation of evidence.

Attorney General for India R Venkataramani  sought a stay on a paragraph in the High Court's order which had observations on the State police in a negative light.

On the State's challenge, the advocates pointed out that the plea was coming up next week. The Court then agreed to take up the matter on May 17, to consider the aspect of stay.

The High Court had found serious lapses in the investigation and evidence while acquitting the accused.
