The Supreme Court on Friday dismissed a plea by a Lucknow-based lawyer challenging the restoration of Nationalist Congress Party Leader Mohammed Faizal's Lok Sabha membership.
The petitioner, Advocate Ashok Pandey, contended that once a Member of Parliament (MP) loses their office by due to conviction in a criminal case, they will continue to be disqualified until their acquittal by a higher court.
Today, a bench of Justices BR Gavai, Aravind Kumar, and Prashant Kumar Mishra dismissed this public interest litigation (PIL) petition. Not only this, the court also imposed an extraordinary cost of one lakh on the lawyer for filing the PIL.
Why are you filing a frivolous petition despite being a lawyer, the bench asked the petitioner.
Last week, a bench led by Chief Justice DY Chandrachud had imposed a cost of five lakhs on Pandey for filing a petition contending that the oath taken by the chief justice of the Bombay High Court was invalid as he did not use the word 'I'.
Pandey has filed another petition challenging the restoration of Lok Sabha membership of Rahul Gandhi, which is pending.
(The initial version of the story incorrectly mentioned that the petition against Rahul Gandhi's membership was dismissed. The mistake was since corrected. The error is regretted)
