Supreme Court has on Monday dismissed with costs, a plea filed seeking directions regarding tests and treatment to be conducted for treatment of covid. The Court also pulled up the petitioner, a commerce graduate for filing a petition without any knowledge on the subject.
A three-judge Bench led by CJI Ramana called the petition 'frivolous', and imposed a cost of Rs 1000. The Court has directed him to pay the cost to Legal Services Authority of Calcutta High Court and submit a report to Supreme court.
"This is a frivolous plea filed by petitioner who doesn't have any any knowledge about the subject. He himself admitted he is a commerce graduate. The Petitioner wants us to direct what type of tests and treatment has to be conducted for treatment of covid. We'll impose cost." the Bench observed.
The Bench had initially observed that it will impose a cost of 1 lakh for such a 'frivolous writ petition', but after the petitioner submitted that he only had an amount of 1000, the Court decided to impose Rs 1000 as the cost.
During the hearing, the petitioner in person Suresh Shaw was asked by the Court if he was a doctor, and what knowledge does he have of covid.
The petitioner informed the court that he was not a doctor, and his plea based on scientific papers, not his knowledge.
"You're not a doctor, medical student or a scientist. What's your knowledge of covid!" CJI remarked
In response to the Court's query regarding the educational qualification, the petitioner in person informed the Court that he has done masters in commerce.
"You want to prescribe covid medicines to whole world? A commerce graduate will teach doctors medical professionals all over the world how to treat covid? How much cost can we impose for filing frivolous plea and wasting time. We'll impose cost of 10 lakhs for this." CJI observed.
At this juncture the petitioner told the Court that he is unemployed.
"So its a business for you? Filing such frivolous writ petition." the Bench said.
"What's your knowledge in science? And you want to give lecture and give treatment covid people. And not being satisfied with observations of Calcutta High Court, you came here all the way? Because its online so there's no expense, and you can talk anything?" the Bench added.
