Supreme Court bench comprising Chief Justice DY Chandrachud and Justice PS Narasimha refused to entertain a Public Interest Litigation seeking effective tax regulations on the sale of personal cars and allowing only one personal car per person.
The bench held that the prayers sought in the PIL were a matter of policy and could not be decided upon by the court. CJI DY Chandrachud remarked–
"This is clearly a policy matter. Ensure effective tax, allow one car per person, second car with environmental tax, committee for air poliution- these are all policy matters...Revenue side of the govt is keeping pace with the law makers. We don't have to come to their aid. We cannot intervene in all areas of governance or issues of policy."
Accordingly, the bench did not entertain the petition and provided liberty to the petitioner to pursue remedies under law.
The PIL had sought the following reliefs–
1. Ensure effective tax regulations on sale of personal cars;
2. Allow only one personal car per person;
3. Allow second personal car only after imposing some environmental tax;
4. Initiate National Program to control Air Pollution;
5. Direct health Authorities to release Advisory for Air Pollution.
