'Don't Make This Court Fun' : Supreme Court Dismisses Law Student's Plea To Allow Supply Of 'Miraculous' Herbal Concoction As COVID Cure

The Supreme Court  on Friday dismissed a PIL filed seeking directions to restart supply of a herbal medicine from Nellore, Andhra Pradesh claiming that it has cured COVID-19 terminally ill patients miraculously.

A three-Judge Bench headed by CJI NV Ramana issued the direction in a law student's plea filed seeking directions to allow the supply of the herbal concoction made by Shri Bonigi Anandaiah from Krishnapatnam Town, Nellore District, Andhra Pradesh.

During the hearing, the Bench initially asked the Counsel appearing for the petitioner to approach the High Court.

"Yes what do you want? Go to High Court" CJI said.

"Technically yes. The writ petition has become infructuous." the Counsel replied.

"Don't make this court fun. Dismissed." CJI further said

The Bench then dismissed the plea and also refused to accept the Counsel's request to dismiss the plea 'as withdrawn'.

While stating that the Ministry of Ayush has not found anything harmful in the medicines, the plea has stated that the herbal concoction has shown miraculous results to many patients, including critical patients with low blood oxygen levels.

The plea has also challenged the District Management's order while seeking support to Shri BonigiAnandaiah to increase the concoction's production and distribution. The supply of the concoction was prohibited by the District authorities for lack of scientific evidence in terms of the medicine's efficacy and no permission through any pre- established procedure.

The petition stated that considering the current circumstances when thousands of lives are being lost daily, the government's decision to stop distribution of the Herbal Concoction made up of 100% natural ingredients and with no side effects is arbitrary and unreasonable.
