The Supreme Court on Monday directed the District Magistrates and Collectors to ascertain the educational status of those children who are eligible for the benefits under PM-CARES Fund and forward it to the Central Government.

A bench comprising Justices L Nageswara Rao and BR Gavai issued the direction in the suo motu case "In Re Contagion Of COVID Virus In Children Homes( SMW(c) 4/2020)".

Amicus Curiae Gaurav Agrawal also brought to the notice of the Court the issue of children having lost parents to the COVID-19 pandemic receiving benefits under the PM-CARES for Children Scheme which has been under the Court's consideration.


Additional Solicitor General Aishwarya Bhati shed light on the progress being made under the Scheme. She submitted that out of the 4848 applications received, 1719 had been approved by the District Magistrates.

The Bench noted that the duty lay on the state government to identify and approve the people eligible under the PM-CARES for Children Scheme so that Centre can release the support that the children are eligible for. The Bench enquired the status of the 1717 children whose applications had been approved by District authorities, whether the benefits had been made available to them.
ASG Bhati submitted that some progress has been made on this front- for those aged above 18 years, accounts had been opened and for minors, joint accounts are being opened with District Magistrates. ASG sought time to seek instructions and submit a detailed status report on the implementation.

This matter will be listed after 2 weeks. The bench also directed that the title of the suo motu case be amended as ""In re: Children in need of Care and Protection due to Loss of Parents during Covid-19".
