In a matter where the bail application of a 78 years old man wasn't heard by High Court on account of non-appearance of CBI's Counsel, the Supreme Court of India on Wednesday  requested the Allahabad High Court to dispose of the bail application expeditiously and preferably within a period of six weeks.

A Bench comprising the Chief Justice of India NV Ramana, Justice Surya Kant and Justice Hima Kohli issued the direction considering that the petitioner is 78 years' old and is suffering from prostate cancer.

The Bench has clarified that even if the counsel for CBI does not appear on the next date of hearing, the High Court may proceed further and dispose of the application for bail preferred by the petitioner in accordance with law.

In the present case, the main grievance of the petitioner is that the bail application preferred by him has been listed before the High Court for 15 times, but the same has not been heard on account of non-appearance of the counsel for the Central Bureau of Investigation (CBI).

The Bench was hearing a special leave petition filed challenging Allahabad High Court's order disposing of petitioner's parole/short term bail application by directing the Jail Superintendent to get him examine by doctors of Jaipur Medical College.

The parole application was filed by the petitioner on grounds that he is suffering with prostate cancer along with Urinary Retention since last three years and due to prostate cancer he has some complications, like hypertension etc.

The High Court had directed the Jail Superintendent, Central Jail, Jaipur, to produce the petitioner Virendra Singh before a team of three senior doctors of Urology Department of Jaipur Medical College, who would examine him and treat him accordingly. Further, if the team of doctors suggest that any operation/surgery is required, then the same would be done under the supervision of the Jail authorities.
