The Supreme Court today issued notice on a plea by Uttar Pradesh MLA Abbas Ansari seeking permission to attend 'Fatiha' ceremony scheduled on April 10 in respect of his father Mukhtar Ansari, a gangster-turned politician who died on March 28 following a cardiac arrest while undergoing sentence of life imprisonment.

It may be recalled that Abbas Ansari is currently in jail over an arms license case. In November last year, he was denied bail by the Allahabad High Court, noting that huge quantities of arms and ammunition were recovered from his premises in New Delhi. The High Court further cited the risk of Ansari influencing witnesses and tampering with evidence.

During today's hearing, Ansari's counsel-Advocate Nizamuddin Pasha mentioned to the Bench of Justices Surya Kant and Sandeep Mehta that the petition was originally filed for attendance of funeral rites. However, the same could not be listed in time and as such, Abbas now seeks to attend the Fatiha ceremony which is scheduled on April 10.

Issuing notice, the Bench permitted Abbas to amend his petition and listed the matter for April 9. A copy of the amended petition was directed to be served to respondent-State in the meantime.

"Registry is directed to list the matter on 9th April, if need be, after seeking prior approval of Hon'ble the Chief Justice", Kant J dictated. The judge could be heard clarifying to Adv Pasha that he would not be holding Court on April 8 and was therefore listing the matter for April 9.

The counsel was asked to make a mention of the matter on the morning of April 9.
