The Calcutta High Court on Monday asked the CBI whether it had ever believed that more than one person, other than convict Sanjoy Roy was involved in the RG Kar rape and murder case or the larger conspiracy to cover up the incident.
Justice Tirthankar Ghosh was hearing a plea by the victim's parents seeking further investigation after the Supreme Court asked them to approach the HC for relief. The parents sought a probe into the larger conspiracy around the rape of the victim and subsequent cover-up by the college authorities.
You must tell me if at any time you took into consideration for investigating under section 70 of BNS (gang rape)? Accused was convicted. What was the nature of your charge? Was it a sole accused or a gang rape? You must make it clear. Then I will ask for reports...Was the crime committed by the sole accused? What was the nature of charges? If you ever believed more than one person was involved, who were the people in your mind? You must tell the court. Was it gang rape or destruction of evidence where multiple people were involved? the Court asked the CBI.
It thus asked the CBI to file its report and listed the matter for hearing on Friday, 28th March. The State has submitted that it did not have objections to the further investigation but questioned whether the law would allow such further probe after the trial was concluded, without the petitioner's approaching the trial court.
