The Supreme Court on Wednesday imposed costs of Rs. 1 lakh on a petitioner for a "gross abuse of the process of the law", having approached the Court repeatedly for the same cause in successive proceedings.
The bench of Justices Rohinton Nariman, Navin Sinha and K. M. Joseph also demanded an explanation from the Supreme Court registry on how such applications are being listed.
"You have come before us in a review petition which was dismissed, then in a writ petition to recall an earlier order which was also dismissed, then in a contempt petition and now, yet another application! This is a gross abuse of the process of the law! We will impose very heavy costs!", observed Justice Nariman.
"We also want a note from the registry as to how such petitions are listed?!", said the judge.
"I was never heard on the grounds of fraud. The possession was handed over to the auction purchaser. There was a fictitious document...", urged the petitioner-in-person.
"Stop compounding your offence! If you make false statements, we will issue perjury notice against you! Look at the order dated April 9, 2019- it specifically records that you have been heard! It specifically records that the review petition was dismissed and then the writ petition was dismissed! Don't tell us you have not been heard!", reprimanded Justice Nariman.
"The petitioner tells a blatant lie that he has never been heard before, even when the same ground of fraud was resuscitated in a review petition, a writ petition and a contempt petition. This is a gross abuse of the process of the law. We direct costs of Rs. 1 lakh to be paid by the petitioner within 8 weeks. The Registry is also directed to explain how such applications are being listed", ordered the bench.
