Sibal now cites the Kihoto Hollohan v. Zachillhu & Ors case, and refers to Page 675, Issues E and F.
In Kihoto Hollohan, the SC had upheld the sweeping discretion available to the Speaker for deciding disqualification cases.
Sibal submits that the matter had been placed for further orders on July 24.
“But, there was no specific order. The Court cannot direct Speaker to extend time. No decision can be taken, said the court, and extended the time. That can’t be done.”
Senior Advocate Kapil Sibal, arguing for Rajasthan Speaker CP Joshi, submits to the Bench that his argument is on a narrow footing.
