"You Are Too Senior To Implead In this Case": SC Tells Shanti Bhushan In Prashant Bhushan- Tehelka Contempt Case [Courtroom Exchange]

The bench says that the matter will be heard next on August 4.

Sibal says that some time to prepare must be given.

Justice Mishra says he knows his responsibility.

Sr. Bhushan says his (impleadment) application must be heard and decided therefore.

Justice Mishra says that this is a suo motu issue and that the argument is not a legal one - but an emotional one.

Senior Advocate Shanti Bhushan seeks impleadment in the case.

“The case has been pending since 2009, I would request My lords to hear this when physical courts resume. Impleadment pending”

Justice Mishra says that “Mr. Bhushan, you are Too Senior to be impleaded”

Dhavan says he normally does not make a request of this kind - to seek an adjournment.

Justice Mishra: We need to hear the matter, will give you time so as to let you prepare “to your satisfaction”

Bench says many matters being taken up via Virtual Hearings on Videoconferencing. “Why can’t this be taken up?”

Sibal says not a preliminary hearing or impending issue which circumscribes in this matter.

“Moreover, need to go through the records”

Sibal says he supports what Dhavan is saying.

Says that he is also yet to go through the documents in the case at length as many years have passed since proceedings were taken up last.

Senior Advocate Rajeev Dhavan: The record in this particular case will have to be gone through thoroughly. Mr. Ram Jethmalani was leading the case who has passed away.
