A plea has been filed before the Supreme Court seeking directions to the PM-CARES Fund to fund immediate procurement of COVID-19 Vaccine, oxygen plants and generators and their installation in 738 district hospitals which are easily accessible at no costs to common people and presently desperately seeking medical oxygen for Covid treatment.

The plea filed by Advocate Viplav Sharma has also urged the court to consider enlarging the short limited cap of three months exemption period granted on import duty of the medical equipment relating to medical oxygen generation.

According to the petitioner, the period of 3 months is "too short a period from the standpoint of logistics involved in importing these equipment".

The plea has sought preparation of 'National Plan' in consultation with the Chief Secretaries or State Ministries to successfully combating pandemic disease of Corona Virus (COVID -19) and adverse repercussions arising.

The petitioner has urged the court to direct the Union Secretary and all Chief Secretaries States to direct the Members of Parliament and Members of Legislative Assemblies to spend their MP/MLA funds in disciplined manner with full transparency so as to best serve the community they represent from their respective constituencies.

The plea has further sought directions to the High Courts to issue appropriate administrative instructions to its sub- ordinate Judicial Officers to ensure compliances of directions that may be passed by the top Court.

The petitioner has urged the Court to issue directions to the States to ensure that all the private and charitable Hospitals have 'actually' procured, installed and commissioned the medical plant and equipment with essential backups and, have become self- sufficient in having more than adequate inhouse basic and essential life support service of medical oxygen.

The plea has sought directions to the States to ensure setting up of electric and all other kinds of crematoriums in all cities within their respective administration. Further directions for maintenance and improvement of the existing electric crematoriums have been sought as they have all been used much beyond their respective capacities and may soon get non-functional.

The plea has sought the Court's urgent interference for issuance of appropriate directions to the Union of India and all State Governments to take urgent and effective measures to ensure that they aptly and successfully combat second wave of pandemic disease of Corona Virus.

Further, the directions will also effectively resolve the serious impact and disastrous repercussions that had instantly emerged countrywide owing to lack of medical oxygen in all the Hospitals throughout the country which led the whole nation struggling to cope with the skyrocketing infections and a daunting shortage of medical oxygen.
