A public interest litigation (PIL) has been filed before the Calcutta High Court by an advocate seeking to modify the roster/determination of Justice Amrita Sinha, to prevent her from hearing cases related to police over-action or inaction.

The matter was heard by a division bench of Justices Apurba Sinha Ray and Kausik Chanda, who directed for the matter to be placed before Chief Justice TS Sivagnanam for necessary directions. 

Advocate Sanjoy Das, the petitioner claimed that since the West Bengal CID was investigating Justice Sinha's husband for allegedly using his spouse's office to influence a probe, her determination over police matters would not inspire public confidence in the judicial system.

Earlier, the Supreme Court had disposed of a plea claiming that the judge and her husband had attempted to interfere in an ongoing police investigation by allegedly trying to influence the complainant. 

Upon hearing the plea, the division bench stated that the petitioner had raised 'a valid question of law' and accordingly placed the matter before the Chief Justice in order for him to exercise his administrative powers. 

The matter has been placed before Chief Justice TS Sivagnanam on the day the Court reopens from summer vacation, i.e. 10th June.
