CJI to Divan: First we will ask SG if they want time to file affidavit. If yes you don’t need to strain. If he says no, this is it, you can carry on
Divan: I’ve fundamental rights violated by State. I can seek interim relief. It isn’t a matter which should be allowed to be torched by Union of India by filing this skimpy 2 page affidavit
CJI: Their small objection is that Government hasn’t disclosed anything. Mr Sibal and Mr Dwivedi have said let them disclose it
Dwivedi: The question in all petitions is against the government! So government forming a committee will not create any confidence in people.
Dwivedi: They haven’t stated who are going to be members of this Committee. If at all it’s constituted it has to be an independent committee under supervision of this Court.
Dwivedi: So dar there is no denial, no statement regarding law supporting the user or a statement that it wasn’t used against me. Give them time, these are statements they need to make.
