With wishes to keep her matrimonial ties intact, a Muslim woman has approached Supreme Court for declaration of talaq given by her husband as illegal.
Writ petition before the top court has been filed by Smt. Ruby against her husband Shahid Parvez contending that talaq notices from Parvez are in violation of the order passed by the apex court in Shayara Bano v. Union of India & others.
A bench of Justices Indira Banerjee and Sanjiv Khanna said it will hear the plea on Friday.
Couple had entered into wedlock in 2010 and has two children, a son and a daughter, from the marriage. Petitioner alleges harassment by her in-laws' and husband for the additional dowry of 5 lakhs and a car.
She alleges she was beaten and ousted from matrimonial home with malicious intentions of sending her divorce later. After then respondent sent her two talaq notices which are in clear violation of mandate of Supreme Court order, it says.
Petitioner has asked for order against respondent for declaration of talaq notices as illegal and direction to government and police towards taking steps for registration of FIR against the respondent as per Muslim Women (Protection of Rights on Marriage) Ordinance-II 2019. She has also asked for direction to respondent to keep the marriage intact in accordance with Supreme Court order in Shayara Bano case.
Supreme Court declared practice of instant triple talaq as void with its judgment in 2017 in case of Shayara Bano v. Union of India.
