Mohammed Zubair, the co-founder of fact checking website AltNews, has approached the Supreme Court challenging the Allahabad High Court's refusal to quash an FIR registered against him for a tweet in which he allegedly called 3 Hindu seers- Yati Narasinghanand Saraswati, Bajrang Muni and Anand Swaroop as 'Hate mongers'.
Senior Advocate Colin Gonsalves mentioned the matter today before a vacation bench of Justices Indira Banerjee and JK Maheshwari for urgent listing.
"This relates to Mohammed Zubair, the co-founder of Alt News. His job is to fact check news, and he was doing the role of identifying hate speeches. A look at the FIR shows that there is no crime. We went to Allahabad HC, but no relief granted. Bail is sought on emergency. There are death threats on the internet. If possible list today at 2. I am really worried", Gonsalves submitted.
The bench said that the matter can be listed tomorrow, subject to assignment by the Chief Justice of India.
Zubair was arrested on June 27 by the Delhi Police in a case for alleged hurting of religious sentiments over a tweet posted by him in 2018. Earlier this week, he was produced before Sitapur Magistrate in Uttar Pradesh in relation to the FIR registered by the UP Police.
On June 10, 2022, a division bench of the Allahabad High Court had refused to quash the FIR of UP Police saying that it was premature to interfere when the investigation was at a preliminary stage.
