Petitioners seeking a review of the 'Marriage Equality' decision requested the Supreme Court to have an open court hearing of the petition.
Senior Advocate NK Kaul appearing on behalf of one of the review petitioners requested the CJI DY Chandrachud on the possibility of having the review petition hearing in open court instead of in chambers since the matter involves large public interest.
"We would humbly request would Your Lordships consider that in public interest these hearings could happen in open court, my lords?"
The CJI however said that traditionally review petitions happen only in chambers.
It may be noted that on July 10 the Top Court is scheduled to review its earlier decision in Supriyo v. Union of India where the Top Court refused to recognize same-sex marriages as valid in law.
Notably, the review petitions will be considered by a new bench composition since two judges of the 5-judge bench which delivered the judgment- Justices Sanjay Kishan Kaul and S Ravindra Bhat- have since retired.
Justices Sanjiv Khanna and BV Nagarathna replace the retired members of the bench. The other judges are Chief Justice of India DY Chandrachud, Justice Hima Kohli and PS Narasimha.
