Bench reconvenes :
Justice Khanna : We have reserved the judgment.
Singhvi : Deeply obliged for a patient hearing.
Matter concludes.
Bench closes the arguments in the case.
Justice Khanna says the bench will take a break for ten minutes and will come back.
Singhvi : Court has directed to give me unrelied documents. ED has challenged that and the proceedings have been stayed. Did they say that?
ASG objects.
Singhvi : Allow me to read the order of HC, it says proceedings are stayed.
Singhvi : CBI has filed chargesheets, 294 witnesses and 31, 000 documents.
ED has filed 5 chargesheets, with 160 witnesses, and 21,000 documents. So 50,000 documents and about 500 witnesses. Further investigation is going on, they say.
Singhvi : ED, of all the people, wants Vijay Madanlal Chaudhary judgment to be reconsidered?
ED as a premier investigative agency is bound to be transparent.
Singhvi : Generation of proceeds of crime occurs only in the predicate offence. This is held in Vijay Madanlal Chaudhary judgment.
Singhvi : And Ministers change their phones. It is a ministerial phone. And it was discarded before the registration of FIR. It becomes a tampering of evidence?
Singhvi : Vijay Nair has got bail in predicate offence. There is no evidence connecting me to Vijay Nair.
Singhvi : I am pointing out that something which is not even in the chargesheet is being pointed out. There is no real investigation.
Singhvi : Look at how far they are going in a bail...they say I forced someone (Mahadev) in Punjab to withdraw for the benefit of someone in Delhi...And under the new policy, a manufacturer cannot be a wholesaler. Could Mahadev have a license in Delhi and a distillery in Punjab? The answer is no.
Justice Khanna :Let us not go into the money trail chart of the Goa elections.
Singhvi: This is persecution by hook or by crook.. this reply was filed after the SC questioned on the money trail on August 4, 2023. Material has to be what is on record and new material cannot be given.
