Rohatgi: The two orders given right now. One is non-speaking order. The second is in a petition under 32. I have not come under 32, I have come under 136.
Dave: There’s one more disturbing problem. The HC has issued suo moto contempt against us. They said that we didn’t take him to the hospital. Please stay that order.
Dave now refers to the order in Kerala Union of Working Journalists (Siddique Kappan matter) where the Supreme Court Bench headed by former CJI Bobde told him to go to the competent court.
Dave: There’s another order in Akhil Gogoi’s matter. A young boy, he was recently elected from jail. There, the Court was not inclined to entertain the bail matter.
Dave asks Nazki to present to the Court two orders by former CJI Bobde wherein he had directed Kerala journalist Siddique Kappan in Hathras matter to approach the High Court.
When ordinary citizens are directed to go, they go. If an ordinary citizen can’t get protection, then MP should not either.
Nazki wishes to remind Dave that HC mentioned contempt.
Dave: The Court says that concerned trial judge can be referred to and he can stay in Army hospital. But, I beseech to your Lordship that do not entertain 136 petition.
Dave: We have complete faith in CBI. It’s not that I am running away from CBI. But, this kind of request that send it to CBI.
Bench: There’s no application.
Dave: They’ve filed it today. Just turn to the HC order.
Dave reads out statements related to the Bhima Koregaon matter.
Dave: These are similar statements. There’s only difference of degree. And the Court rightly said that they are seditious statements.
Dave: Large number of citizens in Delhi Riots, Bhima Koregaon matter, and even the journalist in Hathras matter are in custody due to sedition and relief is denied to them. Rohatgi himself has stated that sedition is being invoked.
