Bench dictating the order : Per contra, Dave has submitted that since there is an alternate remedy with the Petitioner by filing a bail application before trial court, the HC had rightly delegated the matter and the SC should not interfere specially because the HC has not considered matter on merits

Bench dictating the order : Ld. Counsel has submitted that detention of Petitioner in AP Police custody would not be safe for Petitioner and that he should be enlarged on bail.
Bench dictating the order :Mr.Rohatgi submits that he was tortured by police in custody so much so that there is an undisplaced fracture on second toe of left foot. He further submitted that edema and other difficulty in movement of ankles is a result of torture of Petitioner.
Bench dictating the order : Placing reliance on the report of the Army Hospital, Rohatgi submitted that from a bare perusal of report it is clear that Petitioner has been ill-treated.
