The Supreme Court will pronounce orders today at 10.30 AM in EWS/OBC quota case. Court will decide whether to allow NEET-PG Counselling 2021 to commence on the basis of existing reservation criteria.
A bench comprising Justice DY Chandrachud and Justice AS Bopanna had reserved orders yesterday after hearing extensive arguments for two days.

The Court passed an interim order with the following directions :
1. We accept the recommendations of the Pandey committee that the criteria which has been stipulated in OM 2019(for EWS) be used for 2021–20 22 in order to ensure that the admission process is not dislocated
2. Counselling on the basis of NEET PG 2021 and Neet UG 2021 shall be conducted by giving effect to the resolution as provided by the notice dated 29 July 2021 including the 27% reservation for OBC category and 10% reservation for EWS category in the all India quota seats
3. The criteria for determination of the EWS notified by OM 2019 shall be used for identifying the EWS category who appeared for Neet UG and Neet PG 2021 examinations
4. The validity of the criteria determined by the Pandey committee for identifying the EWS prospectively for the future be subject to the final results of the petitions
5. The petition shall be listed for final hearing on the validity of the EWS criteria as recommended by the Pandey committee in the third week of March 2022.
The bench has now listed the petition for final hearing for determine the validity of EWS criteria as determined by the Pandey Committee in the 3rd week of March, 2022.
BREAKING :Supreme Court Allows NEET-PG Counselling For 2021-2022 Based On Existing EWS/OBC Reservation.
DYC J: We have upheld the validity of OBC.
In EWS, we've upheld the criteria for this year so that the admissions are not dislocated for the current academic year.
We will hear the petition wrt to the EWS criteria later.
We accept the recommendation of the Pandey committee to apply the criteria from next year.
Counselling shall be conducted by giving effect to the reservation of the OM.
Validity of the criteria by Pandey committee would prospectively be subject to the result of the petition in future.
DYC J: Submissions which have been urge before this court necessitate an interim order. Formulation of the reasons would take some time.
Validity of OBC reservation in NEET PG and UG has been upheld and the reasons follow.
DYC J: Petition was taken up for urgent hearing.
We've heard counsels.
DYC J: Later the SG had informed the court that UOI had decided to revisit the criteria and time was granted. UOI formed the committee on Nov 30 and the committee gave its report on Dec 31, 2021.
DYC J: On Oct 21, this court sought clarification of the OM. 2 weeks were granted to UOI in this regards. On Oct 25, the UOI on its own accord deferred the counselling. Affidavit was filed on Oct 26.
DYC J: Notice takes effect from the current AY, petitioners are doc who appeared in NEET PG. Notice was issued on September 6 and results were announced on September 28. Arguments were heard on October 7, 2021.
