The bench permits the officer who passed the orders for demolition of #KanganaRanaut's home and #sanjayRaut to be joined as parties in the case.

Saraf: If I am alleging malice in fact, then I have to give the officer who passed this order and #sanjayraut to come and answer in his personal capacity.

Saraf: I will argue that there is malice in law while effectuating this demolition.

Bombay HC: What about the "Ukhaad dia" caption? In that case, you have to implead #sanjayRaut. 

Advocate Birendra Saraf says that even if the notice is served, the SC has already stipulated that the corporation may not take action for at least 7 days.

Bench asks Carlos if a notice under section 354 of the Mumbai Municipal Corporation Act, 1935 only if it causes loss to occupiers and others.

"We expect parties to address us on this," the bench says.

Bench says that a DVD has been placed by #sanjayRaut by the petitioner and says that in that case he be joined as party.

"If you are relying on it, you might as well join him"

Counsel for State of Maharashtra says that here is no allegation against the state of Maharashtra and that they may be deleted from the plea.

Bench says they will not delete them just yet.

Advocate Carlos Joel refers to Ranaut's rejoinder.

He says that material aspects of fact have been raised in the rejoinder filed by Kangana 

Bombay HC  is hearing petition filed by Kangana Ranaut against the demolition of her building by Mumbai civic body.

On September 9, division bench of JJ Kathawalla and R I Chagla had stayed the demolition while it was taking place.
