Thampan : In the other matter, the Chancellor is vouching for my appointment. I am a renowned historian.
Justice Devan : There is no allegation of misconduct or mismanagement or lack of qualifications.
Thampan refers to the Kerala HC judgment which dismissed the challenge against appointment of Kannur University VC.
Justice Devan : The Supreme Court judgment was not delivered then. And the quo warranto can be sought on other grounds.
Justice Devan : I don't care about politics. I request all counsels to forbear from referring to politics.
Thampan : What is the larger message to the state. What about students?
Justice Devan : Message is also about incompetent people occupying post.
Thampan : The Governor is creating a turmoil in politics.
Justice Devan : We are on law.
Justice Devan : Chancellor does not become functus officio because appointment was approved.
Thampan : I have my own factual defences.
Justice Devan : I understand that issue, but I am asking if Chancellor has the power.
Thampan : Chancellor becomes the functus officio.
Justice Devan : Appointing authority does not become a functus officio.
Thampan : If a criminal court makes an erroneous order, can the criminal court review the order.
Justice Devan : That is an unfair analogy. Criminal court cannot review because CrPC says so.
Thampan tells the bench that the challenge of Kannur University VC was earlier challenged and it was dismissed by the High Court.
Justice Devan : On what ground it was challenged?
Thampan : That I was overaged.
Senior Adv P Ravindran was the first senior counsel who made the arguments.
Ranjith Thampan also makes the submission that until the appointment is challenged, Chancellor cannot suo motu act.
