Supreme Court is hearing the habeas corpus petition filed by the Kerala Union of Working Journalist seeking the release of Kerala journalist Siddiqque Kappan, who was arrested by the UP Police while he was on his way to Hathras.
Matter adjourned to next week. Kapil Sibal says that the petitioner KUWJ will implead the wife and daughter of Siddique Kappan in the habeas petition.
Sibal : It is shocking what they are doing. In the affidavit numbers of relatives have been given who do not exist and have no relation to the accused.
CJI Bobde : We have said earlier that the matter should go to High Court.
Sibal : I agree. But there are exceptions.
Solicitor General : The bail applications of the co-accused are pending in the lower court. The accused was found with an identity card of a newspaper which was shut three years ago. What kind of a journalist is he?
Sibal : In Arnab Goswami's case, your lordships have interfered when the bail application was pending.
I will rely on that.
CJI : We understand this if the accused is saying this.
Sibal : There are judgments which say the Court should consider the allegations in the FIR while considering release on bail (hints at the Arnab Goswami judgment)
Solicitor General : The petitioner is a third party organization.
Sibal : The FIR itself is false. He is arrested on the basis of false allegations.
CJI asks Kapil Sibal, KUWJ's counsel : Are you willing to go to the Court below?
Sibal : No. There are reasons. The case involves grave violations.
