The Supreme Court on Thursday cleared the decks for the OTT release of the film "Jhund" by staying an order passed by the Telangana High Court against the movie
A bench comprising Justices Indira Banerjee and AS Bopanna stayed the interim order of status quo passed by the Telangana High Court on April 29.
"Prima facie appears that the Impugned Order is clearly against the balance of convenience. The HC has overlooked the principles with regard to grant of interim relief. In any case, claim if any of the Respondent is a money claim. The Impugned Order shall remain stayed", the bench observed while admitting a Special Leave Petition filed by the film's producer Super Cassettes Industries Pvt Ltd (T Series). The bench has posted the petition for disposal to next Thursday (May 12) after issuing notice to the respondent Nandi Chinni Kumar.
On April 29, a single bench of Justice P Sri Sudha passed the interim order on a petition filed by Hyderabad-based filmmaker Nandi Chinni Kumar alleging copyright infringement against the makers of Jhund.
"Let the status quo be maintained by both the parties till the next hearing of the matter i.e. 8th June,2022", the High Court's order said.
He had earlier sought injunction against the theatre release of the film, alleging breach of the terms of the settlement in an earlier case agianst the filmmakers. However, the Trial Court refused his plea to recall the settlement and allowed the film to be released in theatres. Accordingly, the film was released in theatres on March 4.
Meanwhile, Nandi Chinni Kumar moved the High Court challenging the trial court's order and on April 29, the interim order was passed.
Yesterday, Senior Advocate C Aryama Sundaram had mentioned the petition before the Chief Justice of India for urgent listing saying that the movie is slated for OTT release on May 6.
"The movie is being released on OTT on May 6. It has already been released in theatres. The OTT release as announced in March. On Friday, a one line order has been passed by the High Court. They wanted to go back on a compromise. Their challenge to the movie's release was already dismissed", Sundaram had submitted. The CJI then allowed urgent listing for today.
Senior Advocate C Aryama Sundaram, Advocates Mahesh Agarwal, Ameet Naik, Harsh Kaushik, Madhu Garodia, Pranjit Bhattacharya, Sachin Akhoury and EC Agarwala appeared for the film maker in the Supreme Court.
