ASG SV Raju: Separate bench constituted...A common man would never get these benefits.
Sibal: They are trying to topple this government, that's a fact.
Bench rises.
Sibal: Give us some time frame, otherwise...
Khanna J: When you press for it, they will hear you out. We are not going to control the high court.
#SupremeCourt refuses to entertain Hemant Soren's plea under Art 32 challenging his arrest, but leaves it open to him to seek remedy before high court under Art 226 -
"...We are informed that petitioner has already preferred a writ petition before Jharkhand High Court, which is still pending...It will also be open to him to ask for expeditious listing and disposal of the case."
Sibal: There, constitutionality was challenged. Here it is not. Such an order cannot be passed by any reasonable person.
Khanna J: Please go to the high court. We have been following this...
Sr Adv AM Singhvi: Your Lordships have concurrent jurisdiction. There is no necessity to arrest...
Khanna J: There is an earlier order of this court, by a bench of which my sister was a part, asking you to go to HC.
Khanna J: Move to the HC. Initially you filed on basis that notice under Section 50 has been issued. Now an amendment application has been filed since he has been arrest.
Khanna J: Courts are open to everybody. Second, high courts are constitutional courts. If we permit one person, then we have to permit everyone.
Sibal: Your Lordships have discretion. This is a case where that discretion ought to be exercised.
Bench assembles.
Khanna J: Why should you not go to HC?
Sr Adv Kapil Sibal: We are dealing with a chief minister who has been arrested. See the evidence. This is not fair.
