Public Prosecutor Deepak Thakare submits that all tests could be conducted at JJ Hospital too.
Justice Jamdar to Prosecutor- Your own instructions say if medical condition requires then he needs to be shifted to hospital. Then what is the difficulty?
Justice Shinde : Even if he is shifted to Nanavati, he will continue to be in NIA custody.
The bench to Prosecutor : If you say you are willing to take him to Nanavati Hospital, we will not pass an order.
Jaising : Send him(Varavara Rao) to Nanavati and treat him. He is already suffering from multiple organ failure.
The bench asks Jaising if she is pressing for shifting to the hospital or interim bail.
Jaising says she is pressing for hospitalization now as bail requires substantial arguments.
Jaising submits that the State has to ensure that Varavara Rao survives to stand trial.
"It is not beneficial to you if he dies. What if he is acquitted? What is the price we pay?", she adds.
