The Varanasi District Court will pronounce orders today on whether to hear the Order 7 Rule 11 application of Masjid Committee in isolation or together with the Commission report. The Court is expected to lay down the schedule of hearing & order of hearing applications.
Yesterday, District Judge Dr.Ajay Kumar Vishvesha had heard preliminary arguments in the case. The Hindu plaintiffs argued that the the Order 7 Rule 11 plea cannot be heard in isolation and must be considered in the light of the commission report. The Anjuman Intezemia Masjid Committee argued that the application under Order 7 Rule 11 of the Code of Civil Procedure - which seeks to reject the plaint as barred by the Places of Worship (Special Provisions Act) 1991 - must be heard on the basis of plaint averments alone.
The plaintiffs have also filed an application for copies of the Commission Report and the CD and pictures of the survey.
On May 20, the Supreme Court had transferred the suit from the Court of Civil Judge Senior Division to the District Court saying that an experienced and senior judge should handle the matter having regard to its complexities and sensitivity.
The Supreme Court had also directed the District Court to hear on priority the Order 7 Rule 11 application filed by Anjuman Intezemia Masjid Committee (which manages the Gyanvapi mosque).
