There cannot be a complete ban of firecrackers. Strengthen the mechanism to stop misuse - Supreme Court observes during the hearing of challenge against total ban on firecrackers imposed by the Calcutta High Court.
Sr. Adv GS: Maybe the appropriate course, the HC can consider it again with the materials placed by Mr. Grover.
Bench: Where is the opportunity for Cal HC to consider it again? The State government has to devise mechanism to ensure that traders use proper crackers.
Bench to Sr. Adv GS: It was never debated in Cal HC rearing the practical difficulties, Mr. Grover mentioned.
Sr. Adv GS: I was not present during proceedings, I stand by what Mr. Grover said.
Rakhmani: I am told Orissa HC has imposed a complete ban.
Bench: There has to be consistency. Let Orissa HC order be challenged.
Bench: It cannot be a complete ban. Strengthen the mechanism to ensure that misuse is stopped. This mechanism has been specified by NGT and SC.
Rakhmani: Even if your Lordships are permitting, there has to be places demarcated. There are no demarcated areas for bursting of firecrackers. Even WB State Pollution Board has not notified anything.
Adv Rakhmani: The State has to demarcate open grounds for bursting of firecrackers away from hospitals.
Bench: Everything has been specified by the SC. There is nothing new that we have to decide.
Bench: What do you mean by practical difficulties? This was not debated in Court, suddenly it came in the order.
