Hearing ends. Matter to be heard next on April 8.
Solicitor General : Your lorsdship may direct that no body will be called for investigation.
Justice VG Arun records in the order the submission of State that no official witness has been called and will be called.
CGC Suvin Menon tells bench that police officials had called customs officials today morning.
Prosecutor refutes this submission - 'absolutely incorrect'.
Raval : Coercive steps we will not take. But we will continue with the investigation.
Solicitor General : This is adding insult to the injury.
Justice Arun dictates the order : Matter could not be finished though heard in detail. Ld Solicitor General prays for an interim order of stay of investigation. Ld Senior Counsel for the State opposes it.
As the matter is being adjourned due to the paucity of time, I deem it appropriate that the investigating agency does not proceed with coercive steps in respect of the proceedings pending before this court. Post on April 8.
SG : Here you are registering an FIR to undo the investigation by a competent authority.
Justice Arun : Mr Raval has clarified that Customs officials were not summoned.
SG : They could be summoned tomorrow.
Solicitor General : I am pressing for the interim order. No prejudice will be caused if they halt the investigation for ten days. They waited for seven months for FIR.
Solicitor General : The incident is of August. The FIR is of March. The police is the complainant.
Justice Arun to state :Why don't you desist from investigation?
Solicitor General : The investigation which is going on everyday weakens not only the ED case, but also the Customs case, NIA case. It is irreversible damage. Comparative hardship may be seen.
