The Supreme Court has issued notice to the Central Bureau of Investigation (CBI) in a matter seeking bail on medical grounds for former Uttar Pradesh legislator DP Yadav.
Yadav, who is serving life imprisonment in Dehradun jail in connection with a murder, had been earlier granted interim bail in order to undergo spinal surgery at Yashoda Hospital and Research Centre in Ghaziabad. He had surrendered back to jail on 6 December, 2018, post the procedure.
In February 2019, another plea for interim bail on medical grounds had been dismissed by a Supreme Court Bench headed by former Chief Justice of India Ranjan Gogoi, along with Justices Deepak Gupta and Sanjiv Khanna, wherein the Court was not inclined to entertain the petition, but had directed the jail authorities to take the relevant steps according to law to ensure that Yadav's medical needs were taken care of.
Today, a Bench headed by Justice L. Nageswara Rao took into contention the documents of Yashoda Hospital which were submitted by Advocate Vikram Chaudhari, who was representing Yadav. Chaudhari further informed the Bench that the State was opposing the Petition and the Bench sought to hear the stand of the State.
Accordingly, the Bench issued notice to the CBI. The matter will now be taken up next week.
In 2015, Yadav had been awarded life imprisonment by a CBI Court in Dehradun for his role in the murder of Mahendra Singh Bhati, an MLA from Dadri area of Ghaziabad, who had been shot dead in December 1992
